BiteBud Terms of Service
Effective date: October 3, 2026
These Terms of Service (the “Terms”) govern your access to and use of the BiteBud iOS application, website at bitebud.net, and related services (collectively, “BiteBud” or the “Service”). BiteBud is the name under which the Service is provided (“we,” “us,” or “our”). Contact us at [email protected] with questions about these Terms.
By downloading, accessing, purchasing, or using BiteBud, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required to consent to online services in your country, to use BiteBud. If you are under the age of legal majority where you live, you may use BiteBud only with the permission and supervision of a parent or legal guardian.
You may not use the Service if applicable law prohibits you from doing so.
2. BiteBud Is Not Medical Advice
BiteBud is a general wellness and informational tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services.
Calorie, nutrient, weight-change, activity, fasting-stage, meal, recipe, and other estimates may be incomplete or inaccurate. Estimates generated from photographs, barcodes, databases, algorithms, or artificial intelligence should be independently verified before you rely on them. Individual nutritional and health needs vary.
Consult a qualified healthcare professional before changing your diet, fasting routine, exercise program, or weight-management plan, particularly if you:
- have a medical condition, food allergy, history of disordered eating, or are taking medication;
- are pregnant, nursing, under 18, or an older adult; or
- experience dizziness, fainting, pain, or other concerning symptoms.
Do not use BiteBud for an emergency. Contact local emergency services if you believe you may be experiencing a medical emergency.
3. Your Use of the Service
You agree to use BiteBud only for lawful, personal purposes. You must not:
- misuse, disrupt, overload, damage, or interfere with the Service;
- attempt to gain unauthorized access to the Service or another person’s data;
- reverse engineer, copy, scrape, or extract the Service except where applicable law expressly permits it;
- upload unlawful, infringing, malicious, deceptive, or harmful content;
- use the Service or its AI features to develop or train a competing model or service without our written permission;
- bypass purchase, subscription, security, or usage controls; or
- use automated systems to access the Service without our written permission.
We may limit, suspend, or terminate access when reasonably necessary to protect users, the Service, or third parties, or to comply with law.
4. Your Content and Data
You may provide meal photos, food descriptions, voice-derived text, goals, preferences, feedback, and other content (“User Content”). You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, process, adapt, and display User Content only as reasonably necessary to operate, secure, support, and improve the Service and provide features you request. This license ends when the relevant content is deleted from our systems, except for temporary backups, legal retention, and content that has been irreversibly de-identified or aggregated.
You represent that you have the rights needed to provide your User Content and that our processing of it as described in these Terms and our Privacy Policy will not violate another person’s rights.
Core logs may be stored locally on your device. Optional sign-in and server backup can help restore selected data on another device. The backup does not include photo files and does not guarantee every preference or record will transfer. Purchase entitlements and Pebble balances are handled separately. You are responsible for maintaining device security and protecting any backups or exports you create. Deleting the app, losing your device, or clearing local storage may permanently delete information that was not backed up.
If you create an account, keep your sign-in credentials secure and provide accurate account information. You can delete the online account through the account controls in Settings. Signing out, deleting local data, deleting an online account, and canceling a subscription are separate actions.
If you submit a custom food, missing-food request, or nutrition correction for review, you authorize us to review it and, if approved, publish the food name, serving information, and nutrition values in the shared catalog for other users. Approval is not guaranteed. Do not submit private information or content you do not have permission to share. Approved catalog information may remain available after your account is deleted; contact support to report inappropriate content or request removal of personal information.
5. Artificial Intelligence Features
Some BiteBud features use artificial intelligence to analyze images or text and generate food estimates, coaching responses, recipes, or suggestions. AI output may be incorrect, outdated, incomplete, or unsuitable for you. Similar inputs may produce different results.
You are responsible for reviewing AI output before acting on it. Do not submit information you do not have the right to share, and do not rely on AI output as professional medical, nutritional, legal, or other expert advice.
We may impose reasonable technical or usage limits on AI features. Availability and results are not guaranteed.
6. Food Allergies and Dietary Restrictions
BiteBud cannot guarantee that a food, meal, or recipe is free of an allergen or suitable for a dietary restriction. Ingredient data can be missing, mislabeled, changed by a manufacturer, or affected by cross-contamination. Always check product labels and confirm ingredients directly with the manufacturer, restaurant, or food preparer.
7. Third-Party Services and Data
BiteBud is currently an iOS app and may interact with third-party services including Apple Health, the Apple App Store, Firebase Authentication, RevenueCat, Open Food Facts, Expo, OpenRouter, and AI model providers. Your use of a third-party service may also be governed by that party’s terms and privacy policy.
Third-party services have their own terms and operational practices. References or links to third parties do not imply endorsement. This does not exclude our responsibilities for the providers we use, personal-data disclosures, or any rights and obligations that cannot be excluded under applicable law. Our Privacy Policy explains these disclosures.
8. Subscriptions and Purchases
Some features require a paid subscription or one-time purchase. Prices, billing periods, trial terms, and included features are shown before purchase and may vary by region.
Purchases in the iOS app are processed by the Apple App Store. Payment, renewal, cancellation, and refund handling are generally governed by Apple’s terms:
- subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, subject to the rules shown by your marketplace;
- your marketplace account may be charged for renewal within 24 hours before the current period ends;
- you can manage or cancel subscriptions in your marketplace account settings; and
- deleting BiteBud does not cancel a subscription.
Unless required by law, we do not issue refunds for purchases processed by a marketplace. Request refunds through the marketplace that processed the transaction. Any free trial converts to a paid subscription unless canceled before the trial ends, as disclosed at purchase.
We may change prices or subscription features prospectively. Any price change will take effect in accordance with marketplace rules and applicable law.
Pebbles and cosmetic purchases
Pebbles are virtual currency used for eligible in-app cosmetic items and features. They may be earned or purchased where offered. Pebbles and cosmetic items have no cash value, cannot be exchanged for money, and are not transferable between users. Purchased in-app currency does not expire. Spending Pebbles reduces the balance associated with the purchase-service identity. Availability of earned rewards and eligible items may change prospectively, subject to applicable law and Apple’s rules. Any refund rights remain governed by applicable law and the App Store transaction terms.
Promotional pricing
A promotional offer can have a discounted initial billing period followed by the regular subscription price. The offer’s eligibility, discounted period, billed amount, renewal amount, and billing frequency are those disclosed in the purchase flow and Apple’s confirmation. A monthly equivalent for an annual plan is not a monthly billing schedule.
9. Intellectual Property
The Service-including its software, design, text, graphics, mascots, trademarks, logos, and other content excluding User Content-is owned by us or our licensors and is protected by intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use BiteBud in accordance with these Terms. No other rights are granted.
If you provide suggestions or feedback, you grant us the right to use them without restriction or compensation, provided that we do not publicly identify you without permission.
10. Service Changes and Availability
We may update, modify, suspend, or discontinue features. We do not guarantee that the Service or any particular feature will always be available, error-free, secure, or compatible with every device. Updates may be required to continue using BiteBud.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities arising from the Service.
To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of:
- the amount you paid us for the Service during the 12 months before the event giving rise to the claim; or
- USD $100.
These limitations do not apply where prohibited by law, including liability that cannot be limited for fraud, intentional misconduct, gross negligence, personal injury, or violation of mandatory consumer rights.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from third-party claims and reasonable costs arising from your unlawful use of the Service, your User Content, or your material violation of these Terms. This section does not apply where prohibited by applicable consumer law.
14. Termination
You may stop using BiteBud at any time. You can delete locally stored BiteBud data through the in-app settings and may uninstall the app. Subscription cancellation must be completed separately through the marketplace where you subscribed.
We may suspend or terminate your access if you materially violate these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and dispute provisions.
15. Governing Law and Disputes
Applicable law determines the law and courts with jurisdiction over a dispute. These Terms do not impose an exclusive court venue or require arbitration. Nothing in these Terms removes protections or rights to bring a claim in your place of residence that mandatory consumer law provides.
You may contact us at [email protected] and provide a brief description of a dispute so we can attempt to resolve it informally. Doing so is not a condition of exercising your legal rights or meeting a legal deadline.
16. Apple-Specific Terms
If you downloaded BiteBud from Apple’s App Store, you acknowledge that:
- these Terms are between you and us, not Apple;
- Apple has no obligation to provide maintenance or support for BiteBud;
- to the extent required by applicable law, Apple may refund the purchase price if BiteBud fails to conform to an applicable warranty, and Apple has no other warranty obligation;
- Apple is not responsible for claims relating to BiteBud or your use of it;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
- you must comply with applicable third-party terms when using BiteBud.
17. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms and update the effective date. If changes are material, we will provide additional notice where required. Continued use after the revised Terms take effect means you accept them, except where affirmative consent is required by law.
